2 8. The Board met in regular session at 10 A. M. All members present. Permission given to James Oliver to temporarily close & portion of the lst alley West -of lain street, running fron, Washington street to the 1st alley North of WaGhington street, during the construction of an addition to the Oliver Hotel. Bond of W. N. McSherry filed and approved.for Grade, Curb & Talk on Witwer avenue Contract signed for same. .Proposition of Peter Suzio. To Alonzo J. Hammond, City Engineer: WHEREAS_at the,time of the final estimate on the Fassnacht Avenue Trunk Sewer Improvement there remained uncompleted some minor details, and the City of South Bend retained Fifteen Hundeed Dollars of moneys -due me to cover the cost of completing said minor details; and , WHEREAS there is still some of said work remaining. to be done and it is inconve nient for me at this time to superintend the same, I therefore authorize you to do what is necessary to be done in the way of cleaning up and completing the details thereof and charge the cast thereof to me, and I authorize the Board of Public Works, the City Comptroller and the proper officers of the City of South Bend to pay all costs and expenses which you may incur in so doing. This authority shall not be construed.to authorize the payment of any bills or claims against me heretofore incurred, but only to the payment of the actual cost of completing the minor details of the Fassnacht Avenue Trunk Sewer. Dated at South Bend, Indiana, May 20th2 1905. (Signed) "Peter Suzio" The following communication was sent to the Federal Union Surety Co. Federal Union Surety Co., Indianapolis, Ind. Gentlemen; -- You are hereby notified that Mr. Peter Suzio has instructed and authorized the City of South Bend to complete tlse work required on the.Fassnacht Avenue Trunk Sewer and to pay for the same from funds now held by the City for that purpose. Unless this work is taken.up for completion.by your Company within Five(5) days, the Board of Public Works will complete said work according to the terms of Mr. Suzio's proposition, a copy of which is hereto attached. Resolved by the Board of_Public Works of the City of South Bend, Indiana: That the following described property be appropriated for the use of said city: Beginning 50 feet east of the south east corner of Lot 92 Henry Studebakers Second Addition on the north lime of Dayton street, thence north 42 feet, thence east on A line parallel with Dayton street 241 feet to alley, thence south 42 feet to Dayton street, thence west 241 feet to place of beginning.
