<br /> <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br /> <br /> <br />TO: Anne Fuchs, Clerk <br />Board of Public Works <br />FROM: Finn Cavanaugh <br />SUBJECT: Reject Quotes and Re-Open Memo: 121-020 Crack Sealing <br />DATE: May 18th, 2021 <br />On May 11th, 2021, the Board of Public Works opened and read bids for the above project. <br /> <br />The quoters ranked as follows: <br /> <br />Bidder Total Quote Amount <br />1. Asphalt Restoration Services $119,000.00 <br />2. Days Construction $172,200.00 <br /> <br />Neither contractor fulfilled the Good Faith Effort in regards to M/WBE inclusion, thus, neither <br />quote is eligible for award. Asphalt Restoration Services did not contact any M/WBE firms with <br />subcontracting opportunities, so their quote must be considered non-responsive. Days <br />Construction was verified to be a registered MBE, yet did not contact any WBEs with <br />subcontracting opportunities. Regardless, the quote submitted by Days Construction exceeded <br />the available project budget and is likewise not recommended for award. Engineering <br />recommends that both quotes be rejected. <br /> <br />Upon further review of the scope of work by Engineering, Legal, and Diversity and Inclusion, it <br />was concluded that the project cannot reasonably be subdivided as required by the Minority and <br />Women Business Enterprise Inclusion Program Plan §8.B.2, and is thus not a goal-eligible <br />project. <br /> <br />§8.B.2 Non-Goal-Eligible Contracts <br />If a contract is not goal-eligible, either because it is not able to be subdivided into <br />commercially useful functions or because it does not contain any work described in the <br />NAICS Codes in Attachment A, the Program Administrator will not set goals for that <br />contract. <br />
