<br /> <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br /> <br /> <br />TO: Anne Fuchs, Clerk <br />Board of Public Works <br />FROM: Finn Cavanaugh, Project Engineer <br />SUBJECT: Open Quotes Memo: 121-035 Micro-Surfacing <br />DATE: May 18th, 2021 <br />On April 27th, 2021, the Board of Public Works opened and read bids for the above project. No <br />quotes were received by the deadline, and the Board recommended the project be quoted on the <br />open market. <br /> <br />Upon further review of the scope of work by Engineering, Legal, and Diversity and Inclusion, it <br />was concluded that the project cannot reasonably be subdivided as required by the Minority and <br />Women Business Enterprise Inclusion Program Plan §8.B.2, and is thus not a goal-eligible <br />project. <br /> <br />§8.B.2 Non-Goal-Eligible Contracts <br />If a contract is not goal-eligible, either because it is not able to be subdivided into <br />commercially useful functions or because it does not contain any work described in the <br />NAICS Codes in Attachment A, the Program Administrator will not set goals for that <br />contract. <br /> <br />For this project, the crews are small and are performing only one task (asphalt micro-surfacing). <br />There are no specialized sub-tasks like electrical or landscaping work that can be separated out <br />as commercially useful functions. For a contractor to split up the work as a multi-crew job, it <br />would require them to give part of the work away to a direct competitor and would thus not be <br />commercially useful. <br /> <br />At the recommendation of the Legal Department and Office of Diversity and Inclusion, the <br />project shall be re-opened at the May 25th Board of Public Works meeting without M/WBE <br />inclusion goals. As required by the Program Plan §8.B.2 and informed by the recommendation <br />of the Office of Diversity and Inclusion, Engineering will make a special effort to include MBE <br />
