SUBSTITUTE BILL NO. 96-9/4/ <br /> ORDINANCE NO. g51-/`-!(9 q <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA,AMENDING CHAPTER 2,ARTICLE 8 OF THE SOUTH BEND <br /> MUNICIPAL CODE BY THE ADDITION OF NEW SECTION 2-125 ENTITLED <br /> OPERATION SAFE NEIGHBORHOODS PROGRAM <br /> STATEMENT OF PURPOSE AND INTENT <br /> On July 8, 1994, the Members of the Fraternal Order of Police ratified the wage <br /> and fringe benefit package offered by the City of South Bend by a vote of 142 to 9. <br /> One of the component parts of that package was the creation of a new program <br /> "Operation Safe Neighborhoods"Program. The following Ordinance sets forth the criteria <br /> for qualifying officers and sworn members of the South Bend Police Department who <br /> legally establish residence within designated areas of the city to seek housing <br /> reimbursement on a quarterly basis. <br /> The following Ordinance establishes those specific criteria governing the <br /> "Operation Safe Neighborhoods"Program for the South Bend Police Department. <br /> Itotn, Z jtrtfort, bt it ortfaitta by t t Common QCoutttil of tilt (City <br /> of ioutf) HlthaltYa ag foflotus: <br /> Section I. Chapter 2, Article 8 of the South Bend City Code is hereby amended <br /> by the inclusion of new Sec. 2-125 which shall read in its entirety as follows: <br /> Sec. 2-125. "Operation Safe Neighborhoods Program" <br /> (a)Purpose. The City of South Bend desires to provide financial incentives <br /> for officers and sworn members of the South Bend Police department to live in designated <br /> inner city neighborhoods for calendar years 1995, 1996, and 1997. <br /> (b)Eligibility.All full-time sworn members and officers of the South Bend <br /> Police Department who live within the designated areas identified in"Exhibit A"entitled <br /> "Operations Safe Neighborhoods Areas"which is attached hereto and included herein by <br /> reference with one (1)copy being available for inspection during regular business hours in <br /> the office of the City Clerk, may be eligible to participate in the "Operation Safe <br /> Neighborhoods" Program. The maps depicted in "Exhibit A" shall also be posted in the <br /> classroom of the South Bend Police Department, along with a copy of the Ordinance. The <br /> "Operation Safe Neighborhoods"Program is available on a first come first serve basis to <br /> all sworn members meeting the criteria established herein. <br /> (c) Initial Requirements. The following criteria must be met in order for <br /> mortgage or rental assistance to be received in calendar years 1995, 1996, and 1997: <br /> 1)The sworn member or officer of the South Bend Police Department must <br /> complete the required application form for mortgage or rental assistance; <br /> 2)The sworn member or officer of the South Bend Police Department must <br /> purchase or rent a residential unit for his or her own personal use which is located within <br /> the "Operations Safe Neighborhoods" Area as designated by the South Bend Common <br /> Council in paragraph (b) herein, and provide an affidavit signed under penalties for <br /> perjury which verifies residency in the City, dates of such residency, and that liability <br /> insurance on the residential unit is in effect for each quarter; and <br /> 3)The sworn member or officer of the South Bend Police Department must <br /> reside in such designated area for a minimum of twelve (12) months or be subject to <br /> reimbursing the City for the last quarter where such officer or sworn member fails to meet <br />
