WAIVER OF NOTICE AND CONSENT <br /> TO VACATION OF CLARK DRIVE <br /> The undersigned, as owners of abutting real estate within fifty <br /> feet (50 ' ) of the exterior boundaries of the following real estate <br /> to be vacated, hereby waive notice of hearing by certified mail <br /> and consent to the vacation of such real estate: <br /> A dedicated but unimproved street within the City of South <br /> Bend, Indiana known as Clark Drive, legally described as <br /> follows: <br /> A tract of land in the North Half of Section 19, T 38 N, <br /> R 2 E, City of South Bend, St. Joseph County, Indiana, <br /> more particularly described as follows : <br /> Beginning at the Northwest corner of Lot 7 of Landmark <br /> Business Park, Section 1, thence N 89° 43 ' 00" E, 435 <br /> feet, more or less to the west line of Technology Drive <br /> as now dedicated; thence along a 60 foot radius curve to <br /> the right, said curve to be the west line of Technology <br /> Drive; 35 feet more or less to a point on the extended <br /> west line of existing Technology Drive; thence N 00° 54 ' <br /> 38" W, along said extension, 81 feet, more or less to <br /> the PT of a 50 foot radius curve; thence along said <br /> curve through a central angle of 90° 37 ' 38" , a chord <br /> length of 71.10 which bears S 44° 24 ' 11" W, an arc <br /> distance of 79. 09 feet to the end of said curve; thence <br /> S 89° 43 ' 00" W, 379. 45 feet; thence S 00° 54 ' 38" E, <br /> 60.00 feet to the place fo beginning.
