ORDINANCE NO. rt 9ra'Z-gg AN ORDINANCE TO VACATE THE FOLLOWING-DESCRIBED PROPERTY: THE NORTH ONE-HALF OF THE FIRST NORTH-SOUTH ALLEY EAST OF BENDIX DRIVE, RUNNING SOUTH FROM BONDS AVENUE FOR A DISTANCE OF APPROXIMATELY 114 .93 FEET STATEMENT OF PURPOSE AND INTENT Pursuant to Ind. Code § 36-7-3-12, the Common Council is charged with the authority to hear all Petitions to vacate public ways or public places within the City. The following Ordinance vacates the above-described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I : The Common Council of the City of South Bend having held a public hearing on the Petition to vacate the following property: A parcel of land situated in the Northwest Quarter of Section Three (3) , Township Thirty-Seven (37) North, Range Two (2) East of the Second Principal Meridian and being in the City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows: Commencing at the point of intersection of the East line of a north-south fourteen feet (14 ' ) alley with the north line of a fourteen feet (14 ' ) east-west alley, said alleys being shown on the recorded plat of "Westchester First Unit" a subdivision in the City of South Bend, Indiana, and being recorded in Book 13, Page 66, and dated September 4, 1929; thence north, along the East line of said north-south alley a distance of one hundred fourteen and ninety-three hundreths (114.93) feet to a point on the south line of Bonds Avenue; thence West along the South line of said Bonds Avenue, a distance of fourteen feet (14 ' ) to the West line of said north-south alley; thence South, along the West line of said north-south alley a dis- tance of one hundred fourteen and ninety three hundreths (114 .93) feet; thence East, at right angles to the West line of said
