4.Contractordoesnotknowinglyemployorcontractwithanunauthorizedalien,norretainanyemployeeorcontractwithapersonthattheContractorsubsequentlylearnsisanunauthorizedalien.Contractoragreesthathe/she/itshallenrollinandverifytheworkeligibilitystatusofallofContractor’snewlyhiredemployeesthroughtheF-VerifyProgramasdefinedbyl.C.22-5-1.7-3.Contractor’sdocumentationofenrollmentandparticipationintheF-VerifyProgramisincludedandattachedaspartofthisbid/quote;and5.Contractorshallrequirehis/her/itssubcontractorsperformingworkunderthispubliccontracttocertifythatthesubcontractorsdonotknowinglyemployorcontractwithanunauthorizedalien,norretainanyemployeeorcontractwithapersonthatthesubcontractorsubsequentlylearnsisanunauthorizedalien,andthatthesubcontractorhasenrolledinandisparticipatingintheF-VerifyProgram.TheContractoragreestomaintainthiscertificationthroughoutthetermofthecontractwiththeCityofSouthBend,andunderstandsthattheCitymayterminatethecontractfordefaultiftheContractorfailstocureabreachofthisprovisionnolaterthanthirty(30)daysafterbeingnotifiedbytheCity.6.Persons,firms,partnerships,corporations,associations,orjointventurersawardedacontractbytheCityofSouthBendthroughitsagencies,boards,orcommissionsshallnotdiscriminateagainstanyemployeeorapplicantforemploymentintheperformanceofaCitycontractwithrespecttohire,tenure,terms,conditions,orprivilegesofemployment,oranymatterdirectlyorindirectlyrelatedtoemploymentbecauseofrace,sex,religion,color,nationalorigin,ancestry,age,genderexpression,genderidentity,sexualorientationordisabilitythatdoesnotaffectthatperson’sabilitytoperformthework.Inawardingcontractsforthepurchaseofwork,labor,services,supplies,equipment,materials,oranycombinationoftheforegoingincluding,butnotlimitedto,publicworkscontractsawardedunderpublicbiddinglawsorothercontractsinwhichpublicbidsarenotrequiredbylaw,theCity,itsagencies,boards,orcommissionswillconsidertheContractor’sgoodfaitheffortstoobtainparticipationbythosesubcontractorscertifiedbytheStateofIndianaasaMinorityBusiness(“MBE”)orasaWomen’sBusinessEnterprise(“V/BE”)asafactorindeterminingthelowest,responsible,responsivebidder.ContractorsseekingtheawardofaCitycontractcannotberequiredtoawardasubcontracttoan—MWBE;however,theymaynotunlawfullydiscriminateagainstsaidMBE/WBE.AfindingofnoncomplianceoradiscriminatorypracticeshallprohibitthatContractorfrombeingawardedaCitycontractforaperiodofone(1)yearfromthedateofsuchdetermination,andsuchdeterminationmayalsobegroundsforterminatingthecontacttowhichthediscriminatorypracticeornoncompliancepertains.7.TheundersignedContractoragreesthatthefollowingnondiscriminationcommitmentshallbemadeapartofanycontractwhichitmayhenceforthenterintowiththeCityofSouthBend,Indianaoranyofitsagencies,boardsorcommissions.Contractoragreesnottodiscriminateagainstorintimidateanyemployeeorapplicantforemploymentintheperfonnanceofthiscontractwithprivilegesofemployment,oranymatterdirectlyorindirectlyrelatedtoemployment,becauseofrace,religion,color,sex,genderexpression,genderidentity,sexualorientation,handicap,nationaloriginorancestry.Breachofthisprovisionmayberegardedasmaterialbreachofcontract.I,theundersignedbidderoragentascontractoronapublicworksproject,understandmystatutoryobligationstotheuseofsteelproductsorfoundryproductsmadeintheUnitedStates(IC.5-16-8-I).IherebycertifythatIandallsubcontractorsemployedbymeforthisprojectwillusesteelproductsorfoundryproductsmadeintheUnitedStatesonthisprojectifawarded.IunderstandIhaveanaffirmativedutytonotifytheCityinmybidthatmyproposaldoesnotincludetheuseofsteelproductsorfoundryproductsmadeintheUnitedStates.IunderstanditismysoleobligationandresponsibilitytoprovideajustificationtotheCity,subjecttoreviewandapproval,whythecostofUnitedStatesmadesteelorfoundryproductsisunreasonable.PriortoawardanduponsubmissionofbidwhichdoesnotusesteelproductsorfoundryproductsmadeintheUnitedStates,theCity,throughitsdirectorofpublicworks,shallmakeadeterminationifthepriceofUnitedStatesmadesteelorfoundryisunreasonable.Iunderstandthatviolationshereundermayresultinforfeitureofcontractualpayments.Version01/13/2021Contractor’sBidforPublicWorks-5
