HISTORIC DISTRICT COMMITTEE <br />HISTORIC PRESERVATION COMMISSION OF <br />SOUTH BEND AND ST. JOSEPH COUNTY <br />December 2, 1988 <br />Area Plan Commission Conference Room <br />Members Present: Martha Choitz; Committee Chairman, John <br />Oxian; Janeanne Petrass. <br />Members Absent: Gina DeLaurelle <br />Also Present: Joann Sporleder; Lynette Jentoft-Nilsen; <br />Brian Poland; Karen Kiemnec; Leigh <br />Engelhardt, Cameraman, Channel 28. <br />The topic of discussion was the recent introduction of an <br />ordinance in the Common Council to amend the boundaries of <br />the Lincolnway East Historic District. <br />The background on the formation of the historic district was <br />presented. The district was designated in 1984 by the <br />Common Council. In 1985, the National Park Service <br />certified the local district "as meeting substantially all <br />the requirements for listing of districts in the National <br />Register of Historic Places." The district was also <br />determined eligible for listing on the National Register. <br />As a result of this status, one known property owner has <br />taken advantage of the historic rehab tax credit program. <br />The evolution of the districts boundaries were reviewed. <br />The discussion then moved to the particulars of the Council <br />action and the subsequent ramifications. Based on <br />conversations with the N.P.S., it is expected that if the <br />local boundaries are changed, the certification of the <br />district will be removed and may require the payback of the <br />tax credits by the property owner. Ms. Kiemnec expressed <br />concern that a serious negative precedent for the whole <br />state will be set it the council action succeeds. <br />Ms. Sporleder requested that the names on the petition be <br />verified as to them being current owners. Also the Council <br />should be informed that the HPC does not operate under the <br />state enabling legislation. <br />
