ARTICLE 10. FIREARMS PROHIBITED ON CITY PROPERTY <br />DIVISION 1. PUBLIC PLACES WHERE FIlZEARMS ARE RESTRICTED OR PROHIBITED <br />Sec.13-94. Definitions. <br />The following definitions shall apply throughout this Article: <br />(a) Firearns shall have the meaning set forth in I. C. 35-47-1-5. <br />(b) Highway shall mean a street, alley, road, or thoroughfare used by the traveling public <br />or a public way for purposes of vehicular traffic, including the entire area within the right-of-way. <br />(c) Security guard services shall mean an entity or individual or employee of an entity <br />that engages in the business of providing security guard service to the public for hire and is licensed <br />under I.C. 25-30-1.3. <br />Sec. 13-95. Public places where firearms are restricted; exceptions; signs to be conspicuously <br />displayed. <br />(a) Firearms are prohibited in buildings and on grounds owned or administered by the <br />City (excluding all highways). <br />(b) This section shal] not apply to: <br />(1) Law enforcement officers while on duty; <br />(2) Security guard services when under contract to protect the building and <br />grounds or accompanying the delivery of money or valuable goods; and <br />(3) A person who has a valid special police commission which specifically <br />authorizes a firearm and who is acting pursuant to that commission. <br />Such individuals shall be required to provide valid proof of their status as an exception to this <br />division upon reasonable request. <br />(c) Signage Requirements: The person(s) or official(s) in charge of all buildings listed <br />in this Section must conspicuously post signs warning persons of the firearms restrictions at all <br />public entrances to such buildings, and have such signs posted at all major public parking areas on <br />their grounds. However, the absence of a sign shall not be a defense to an ordinance violation under <br />this Article if the Defendant had knowledge of the prohibition against firearms on the premises. <br />Sec. 13- 96. Penalties and confiscation of firearms. <br />(a) Any person found with a firearm on City premises in violation of this Article shall <br />be issued an ordinance violation citation with a fine of fifty dollars ($50.00) for the first violation <br />and a fine of not less than two hundred fifty dollars ($250.00) and not more than two thousand five <br />hundred dollars ($2,500.00) for each subsequent violations.
