Filed in Clerk's OW Exhibit NOV[ V262oi2J INTERLOCAL AGREEMENT JOHN VCCDE MUTUAL AID BOX ALARM SYSTEM CITY CLER SOUTH EEND,std THIS AGREEMENT is made and entered into the date set forth next to the signature of the respective parties, by and between the units of local government subscribed hereto ("Unit(s)") that have approved this Agreement and adopted same in manner as provided by law and are listed at the end of this Agreement. WHEREAS, Indiana law provides for Interlocal Cooperation at IC 36-1-7-1 et seq, and provides that any power or powers,privileges or authority exercised or which maybe exercised by a unit of local government may be exercised and enjoyed jointly with any other local government including a unit of government from another state; and, WHEREAS, Indiana Code IC 36-1-7-1 and IC 36-1-7-2(b) of the Intergovernmental Cooperation act, provides that any one or more public agencies may contract with any one or more public agencies to perform any governmental service, activity or undertaking which any of the public agencies entering into the contract is authorized by law to perform, provided that such contract shall be authorized by the governing body of each party to the contract; and, WHEREAS, the City of South Bend, Indiana is a unit of local government as defined by Indiana Code § 36-1-2-23 existing and operating as a political subdivision of the State of Indiana as defined by Ind. Code § 36-1-2-13; and WHEREAS, the parties hereto have determined that it is in their best interests to enter into this Agreement to secure to each the benefits of mutual aid in fire protection, firefighting and the protection of life and property from an emergency or disaster; and,
