• <br /> BILL NO. <br /> ORDINANCE NO. 1P/1- 89? <br /> 8 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 8 <br /> OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, <br /> BE THE INCLUSION OF NEW SECTION 2-124 ENTITLED <br /> "RETIRING POLICE OFFICERS AND SERVICE REVOLVERS" <br /> STATEMENT OF PURPOSE AND INTENT <br /> The Common Council acknowledges that pursuant to Indiana Code Section <br /> 36-8-2-2, the city is permitted to establish, maintain, and operate a police <br /> and law enforcement system to preserve public peace and order. <br /> The Council also acknowledges that pursuant to Indiana Code Section <br /> 36-8-4-4 a city is required to provide all uniforms, clothing, arms and <br /> equipment necessary for the police officers to perform their duties. <br /> The Common Council believes that it would be appropriate for the City <br /> to present a retiring police officer with twenty (20) or more years of <br /> service to the City of South Bend, his or her service revolver formerly used <br /> in the line of duty. The Council believes that this would be an appropriate <br /> tribute for that officer's dedicated service to the City. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, as follows: <br /> SECTION I. Chapter 2, Article 8, of the Municipal Code of the City of <br /> South Bend, Indiana, is amended by the inclusion of New Section 2-124 which <br /> shall read in its entirety as follows: <br /> SECTION 2-124 Retiring Police Officers and Service Revolvers. <br /> (a) The City of South Bend, Indiana, provides its police <br /> officers with a service revolver for use in the line <br /> of duty. <br /> (b) Upon retirement with twenty (20) or more years of <br /> service to the City of South Bend, police officers <br /> may be authorized to retain as his or her own <br /> property, the service revolver issued to that <br /> officer as a tribute for his or her service to the <br /> City. <br /> (c) The appropriate Board of the City shall make a <br /> determination that said retiring police officer is <br /> retiring in good standing and that his or her <br /> service revolver is determined to be surplus <br /> property and no longer useful to the City. <br /> (d) The Police Pension Board is authorized to make <br /> appropriate determinations and settle disputes on <br /> issues which may arise concerning the award of a <br /> service revolver to a retired policeman/policewoman, <br /> for service to the South Bend Police Department. <br /> SECTION II. This Ordinance shall be in full force and effect from and <br /> afte its passage by the Common Council and approval by the Mayor. <br /> /' � , <br />
