to make with the structure in its current condition at the time the work was bid. Asscher Roofing Company LLC shall not be responsible <br />for differing site conditions that were not visible when this contract was made, unless otherwise stated in the specifications. <br />Insurance and Risk of Loss <br />Asscher Roofing Company LLC will maintain Workers Compensation and Liability insurance during the duration of the project. <br />Customer will maintain insurance covering their own liability. In addition, customer will maintain insurance during the term of this <br />contract that covers the full replacement of the cost of the improvement under contract. If the work at any stage of completion is <br />destroyed or damaged by accident, casualty, disaster, or calamity, including but not limited to fire, storm, flood, or earthquake, the <br />customer and or customer's insurance shall be responsible for such loss. <br />Cleanup <br />Asscher Roofing Company LLC will leave work site in an orderly matter at the end of each work day. When project is complete Asscher <br />Roofing Company LLC will remove all debris and equipment related to this project. Premises shall be left in a neat, orderly condition. <br />Entire Agreement <br />This contract constitutes the entire agreement and understanding between both parties. This contract has no force or effect and is not <br />binding upon The Company until it has been accepted and signed by customer and countersigned by The Company. If construction or <br />this agreement is suspended at any time by the request of the Customer for any reasons including the ones beyond the customer's <br />control. The Customer will be responsible for any and all ensuing expense thereof, including the time and travel of the Company and/or <br />The Company's employees and independent contractors to job site to assess, prepare drawings, filing of construction permits or <br />complete said job. It is expressly agreed that all expenses up to the date of contract suspension shall be assumed and paid by the <br />Customer hereof including but not limited to 40% of The Company's overhead expenses. This percentage will be added to all expenses <br />made by the Company in the customer's behalf during the course of the project. If The Customer fails to pay any invoice according to <br />payment terms, purchaser recognizes and agrees that seller shall have the right to file a lien against purchaser's property. The <br />Customer agrees to be responsible for and pay all of the seller's costs of collection and/or enforcement of the contract, including <br />without limitation, late fees, 2% per month interest, attorney fees, court costs, and recording fees. We the undersigned have read <br />understand and agree to the provisions of this contract and acknowledge receipt of a copy of the same. <br />Buyer's Right to Cancel <br />Buyer may cancel this contract by delivering written notice to the contractor at any time prior to midnight of the third business day after <br />the date of this transaction.
