ORDINANCE NO. Jet Z." - s-S' <br /> AN ORDINANCE CONSENTING TO THE ANNEXATION <br /> BY THE INCORPORATED TOWN OF ROSELAND, INDIANA, <br /> OF CETAIN TERRIRTORY <br /> WHEREAS, the Town of Roseland desires to annex McComb <br /> Street in its entirety, the west half of which is presently <br /> outside the boundaries of the Town of Roseland, and is within <br /> three (3) miles of the boundaries of the City of South Bend, <br /> which territory is more particularly described as follows. to <br /> wit: <br /> Beginning at the intersection of the centerline of <br /> Pendle Street and McComb Street (Kenilworth Rd. ) ; thence <br /> West 20 feet; thence North 2029.30 feet to the north <br /> line projected west of Tax Key Number 03-1129-0001.05 <br /> now owned by the Rulli's and LaCopo's; thence East 20 <br /> feet; thence South 2029.30 feet to the point of the <br /> beginning, containing 0.93 acres and being more <br /> commonly known as the west half of (Kenilworth Rd. ) <br /> McComb Street. <br /> WHEREAS, I.C. 36-4-3-9 (b) provides that a town wishing <br /> to annex territory which is within three (3) miles of the <br /> boundaries of a second class city must first obtain the <br /> consent of the legislative body of such city to the <br /> annexation. <br /> WHEREAS, said territory is not contiguous to the <br /> boundaries of the City of South Bend and the city does not <br /> have use or need for said territory at this time. <br /> THEREFORE, BE IT ORDAINED BY THE COMMIN COUNCIL OF THE <br /> CITY OF SOUTH BEND AS FOLLOWS: <br /> Section I: The City of South Bend does hereby consent <br /> that the above described territory be annexed by the Town of <br /> Roseland. <br /> SECTION II: This Ordinance shall be in full force and <br /> effect from and after its adoption by the Common Council and <br /> approved by the Mayor. <br /> Member of Common <br /> Council <br />
