Inks, Member ATTEST: s /Linda M Martin, Clerk APRIL 2& 2008 ADOPT RESOLUTION NO. 26 -2008 - A RESOLUTION OF TIME SOUTH BEND BOARD OF PUBLIC WORKS REGARDING THE STUDEBAKER. MUSEUM OPERATION AND COLLECTION EXHIBITS Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the following Resolution was adopted by the Board of Public Works: "SOLUTION NO. 26 -2008 A RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS APPROVING TRANSFER OF AL PROPERTY TO STUDEBAKER NATIONAL, MUSEUM WHEREAS, City of South Bend is the owner of the following described real property situated St. Joseph County, Indiana: SEE EXHIBIT "A" ATTACHED (hereinafter referred to as the Real Property); and WHEREAS, the City of South Bend, Indiana ( "City ") acting by and through the Board of Puibi"c Works, hereby expresses its desire to transfer the Real Property to the Studebaker National Museun —,, and WHEREAS, Studebaker National Museum, Inc. is entitled to the Real Property from the (`ity, pursuant to terms and conditions set forth in an Agreement By and Between the City of South Rend, Indiana, by and through its board of Public Works and Studebaker National Museum, Inc. datcd September 26, 2005; and NOW, THEREFO RE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORDS OF T1 F CITY OF SOUTH BEND, INDIANA AS FOLLOWS: 1. The transfer of the Real Property situated in St. Joseph County, Indiana, and generally described as follows: SEE EXHIBIT "A" ATTACHED shall be, and hereby is authorized. 2. Upon receipt of a fully executed quit claim deed to the Peal Property from the City of South Bend, Indiana to Studebaker National Museum, Inc., the Cleric of the Board of Public Works of the City of South Bend, Indiana is hereby authorized and directed to cause the recording of said quit claim in the Office of the St. Joseph County Recorder. 3. This Resolution shall be in full force and effect upon its adoption. ADOPTED at a meeting of the Board of Public Works of the City of South Bend, Indiana held on April 28, 2008, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
