( 8) Compliance schedule reports must be submitted by any <br /> nonresidential discharger not subject to categorical standards who <br /> is not in compliance with the terms and conditions of this <br /> division. <br /> (j ) Emergency suspension of service and permit. The Board of <br /> Public Works may, for good cause shown, suspend the wastewater <br /> treatment service and the discharge permit of a nonresidential <br /> discharger when an actual or threatened discharge presents or may <br /> present an imminent or substantial danger to the health or welfare <br /> of persons, substantial danger to the environment, interfere with <br /> the operations of the wastewater treatment plan, or violate any <br /> pretreatment limits imposed by this division. Any nonresidential <br /> discharger notified of the suspension of treatment service and/or <br /> permit shall cease all discharges to the sewer system. In the <br /> event of failure of the nonresidential discharger to comply <br /> voluntarily with the suspension order within the specified time, <br /> the Board of Public Works shall commence judicial proceedings <br /> immediately thereafter to compel the nonresidential user' s <br /> compliance with such order. <br /> (k) Revocation of permit. The Board of Public Works may revoke <br /> the permit of a nonresidential discharger which fails to: <br /> (1) Factually report the wastewater constituents and <br /> characteristic of its discharge; <br /> ( 2) Report significant changes in wastewater constituents or <br /> characteristics, including periods of noncompliance with applicable <br /> effluent limitations; <br /> ( 3 ) Report modifications of operational and/or pretreatment <br /> processes or facilities; <br /> (4) Refuses reasonable access to the nonresidential user' s <br /> premises by representatives of the wastewater treatment plant for <br /> the purpose of inspection or monitoring; or <br /> ( 5 ) Violates the conditions of this ordinance or any final <br /> judicial order entered with respect thereto. <br /> (1) Notification of violation; administrative adjustment. <br /> Whenever the Board of Public Works finds that a permittee has <br /> engaged in conduct which justifies revocation of its permit, <br /> pursuant to this code, the Board shall serve or cause to be served <br /> upon such permittee a written notice by certified mail, return <br /> receipt requested, stating the nature of the alleged violation. <br /> Within fifteen (15) days of the date of receipt of the notice, the <br /> permittee shall respond in writing to the Board of Public Works <br /> advising of its position with respect to the allegations. <br /> Thereafter the parties shall meet within fifteen (15) days to <br /> establish a plan for the satisfactory correction of all confirmed <br /> violations. <br /> (m) Show cause hearing. Where the violation of this code is not <br /> corrected by timely compliance by means of administrative <br /> adjustment, the Board of Public Works may order any discharger <br /> which causes or allows conduct herein prohibited, to show cause <br /> before the Board or its duly authorized representative, why the <br /> proposed permit revocation should not be taken. A written notice <br /> shall be served on the discharger by personal service, certified or <br /> registered, return receipt requested, specifying the time and place <br /> of a hearing to be held by the Board or its designee regarding the <br /> violation, the reasons why the enforcement action is to be taken, <br /> the proposed enforcement action, and directing the discharger to <br />
