ORDINANCE NO. 30-5/49 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY All Streets and Alleys south of Ewing Avenue and Prairie Avenue(at the North) running south to the South line of the west half of the North east Quarter of Section 22 , Township 27 North, Range 2 East, and from Locust Road east to Grant Street , except 122 . 9 feet of Irvington Street East of Locust Road and 125 feet of Warren Street South of Ewing Street . Also vacating Grant Street running South from Ewing Avenue to its dead-end except for the North 166 ' . The purpose and intent of Mr . & Mrs . Chaang Huei Luan to vacate the -alleys and street is for a subdivision using only the Warren Street access as the main entrance to the north and Irvington Street access to the west . Pursuant to Indiana Code Section 36-7-3-12 , the Common Council is charged with the authority to hear all petition to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS : SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property : All streets and alleys south of Ewing Avenue and Prairie Avenue(at the North) running South to the South line of the West Half of the NE Quarter of Section 22 Township 37 North, Range 2 East and from Locust Road East to the Grant Street except 122 . 9 feet of Irvington Street East of Locust Road and 125 ' of Warren Street south of Ewing Street . Also vacating Grant Street running south from Ewing Avenue to its dead-end, except for the North 166 ' . hereby determines that it is desireable to vacate said property . SECTION II . The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities including , but not limited to the fol- lowing : electric, telephone, gas , water, sewer , surface water control structures and ditches , within the vacated right-of-way unless such rights are released by the individual utilities . SECTION III . The following property may be injuriously or beneficially affected by such vacating : Lots 1 thru 23 of Peak' s First Addition and un- platted Section directly South of Peak' s First Addition . SECTION IV. The purpose of the vacation of the real property is to : Allow a new subdivision SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor .
