PUBLIC WORKS AND PROPERTY VACATION COMMITTEE <br />The April 28, 2008 meeting of the Public Works and Property Vacation Committee of the South <br />Bend Common Council was called to order by its Chairperson, Council Member David Varner at <br />6:20 p.m. in the Council's Informal Meeting Room. <br />Members in attendance included Chairperson Varner; Councilmember LaFountain, Vice- <br />Chairperson; Councilmember Dieter, Member; Councilmember Henry Davis, Member <br />Persons in attendance included: Councilmember Rouse; Councilmember Puzzello; <br />Councilmember Oliver Davis; Chuck Leone; Mike Neises; Kathleen Cekanski-Farrand, Council <br />Attorney; John Voorde, City Clerk <br />BILL NO. 20-08 - A11ey Vacation -Golden 8 Woodward <br />Chairperson Varner recognized the petitioner of the alley who explained his reasons for doing so. <br />Mr. Neisis proceeded to explain he had purchased a neglected property adjacent to the alley. <br />Once a rental, he invested in rehabilitating the house to serve as his home. Because of the <br />proximity of his home to the alley he petitioned primarily for safety and security reasons. There <br />was no opposition from neighbors or the city. Chairperson Varner upon hearing Mr. Neisis <br />intended to share use of the alley with a neighbor to allow access to their garages asked if a <br />formal cross-easement had been filed with the County Recorder. In that there was not, <br />Chairperson Varner with the concurrence of Council Attorney, Kathleen Cekanski-Farrand <br />suggested a continuance until May 12, 2008 to allow time for Mr. Neisis to file the cross access <br />easement. <br />Chuck Leone, a neighbor to Mr. Neisis rose to speak in support. <br />Councilmember LaFountain made a motion to continue this bill until the May 12, 2008 meeting of <br />the Council. Councilmember Dieter seconded the motion. All concurred. <br />There being no further business to come before the Committee, Council member Varner <br />adjourned the meeting at 6:30 p.m. <br />Respectfully Submitted, <br />David A.
