ORDINANCE NO. ST 5(e---90 <br /> AN ORDINANCE OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA <br /> AMENDING ARTICLE 4 OF CHAPTER 13 <br /> OF THE SOUTH BEND MUNICIPAL CODE <br /> ENTITLED "OFFENSES AGAINST PUBLIC <br /> PEACE AND SAFETY" <br /> STATEMENT OF PURPOSE AND INTENT <br /> Section 13-57 of the South Bend Municipal Code prohibits creation <br /> of any loud, raucous, improper, unreasonable, offensive or unusual <br /> noise which disturbs the peace or safety of persons within the City <br /> of South Bend. Although the ordinance is complete as to its <br /> enumeration of prohibited noises and activities, it is incomplete to <br /> the extent it prescribes no penalty for violation of the ordinance. <br /> The purpose and intent of this bill is to prescribe a fixed penalty <br /> to be assessed for violation of Section 13-57 of the South Bend <br /> Municipal Code. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND, INDIANA, AS FOLLOWS: <br /> Section I . Article 4 of Chapter 13 of the South Bend Municipal <br /> Code is amended to add a new Section, Section 13-57.05, which shall <br /> read as follows: <br /> Section 13-57.05. Violation; penalty. Any person <br /> violating any provision of this section shall be <br /> fined in the amount of fifty dollars ( $50.00) , <br /> payable through the ordinance violation bureau. <br /> Each response by any enforcement officer shall <br /> constitute a separate offense punishable by a <br /> separate fifty dollar ( $50.00) fine. <br /> Section II .
