AGENDA REVIEW SESSION OCTOBER 17. 2012 72 <br />The Board of Public Safety met in the Public Agenda Session at 8:08 a.m. on Wednesday, October <br />17, 2012, with Board President Patrick D. Cottrell, and Board Members Laura Vasquez, Eddie <br />Miller, and John Collins present. Board Member Luther Taylor was absent. Also present were Police <br />Chief Charles Hurley, Fire Chief Steve Cox, and Board Attorney Andrea Beachkofsky. <br />The meeting was held in the Board of Public Works Conference Room, 13`x' Floor County City <br />Building, South Bend, Indiana. <br />Board members discussed the following items from the agenda: <br />- Reset Hearing of Charges No. 2012 -05 — Bortone <br />Ms. Beachkofsky stated that due to unforeseen circumstances regarding Christopher Bortone's <br />attorney, he has recused himself from this case and assigned it to another attorney in the firm, and <br />asked that the hearing be reset to a later date. Ms. Beachkofsky stated she is not challenging this <br />request and has spoken to the Board's Counsel, Joseph Simeri, and they have come up with a <br />mutually agreed upon potential date of December 4, 2012 for the Hearing. She noted the Board will <br />need to approve the setting of the Hearing. <br />- Set Hearing of Charges No. 2012 -07 — Stilp <br />Ms. Beachkofsky stated she and Board Counsel, Joseph Simeri, have come up with a mutually <br />agreed upon date of December 7, 2012 for the Hearing of Charges No. 2012 -07. She noted the Board <br />would need to approve the setting of the Hearing. <br />- Approve Findings of Facts — Charges No. 2012 -06 — VanVynckt <br />Ms. Beachkofsky stated the Board previously approved Chief Hurley's recommended discipline, but <br />did not have the Findings of Fact to sign. She noted this is just the paper work follow -up to finalize <br />this action. <br />- Monthly Statistical Analysis — September 2012 <br />Police Chief Chuck Hurley stated the Part I Crimes are still down by 18 %, and homicides are still <br />UP- <br />- Review Grievance — Kuminecz <br />Ms. Beachkofsky stated she did not know that this grievance was going to be continued, but she <br />received a letter yesterday from Mr. Tom Dixon, Attorney for Shawn Kuminecz, asking for the <br />continuance. She stated the Board will make a written determination at their next meeting of <br />November 14, 2012. <br />- Acknowledge Mutual Aid Box Alarm System Interlocal Agreement <br />Fire Chief Steve Cox stated there is a mutual aid agreement between all of the St. Joseph County Fire <br />Departments. He is presenting to the Board a formalized agreement that sets up a system for mutual <br />aid that lays down the system so the Chiefs don't have to figure out a process in a time of need for <br />aid. Chief Cox noted that the South Bend Fire Department is the only St. Joseph County Fire <br />Department that isn't entered into this agreement. He stated not only will it help formalize a system, <br />it could potentially help with the Fire Department's ISO ratings. Ms. Beachkofsky noted this is an <br />Inter -Local Agreement so it will have to go through the Common Council for approval. She noted <br />the Board is only acknowledging the request to enter into this agreement. <br />ADJOURNMENT <br />There being no further business to come before the Board, Mr. Cottrell declared the meeting <br />adjourned at 8:38 a.m. <br />BOARD OF PUBLIC SAFETY <br />Patrick D.
