ORDINANCE NO. g0-70-'90 <br /> AN ORDINANCE TO VACATE THE FOLLOWING <br /> DESCRIBED PROPERTY: <br /> The second east-west alley, north of Hildreth Street, running east from <br /> Esther Street, for a distance of approximately 120 feet to: the west <br /> line of an existing. 16 foot alley in the recorded plats of Bellevue and <br /> John Adams first addition; also the first east-west alley north of <br /> Hildreth Street, running east from Esther Street, for a distance of <br /> approximately 120 feet to the west line of an existing 14 alley in the <br /> recorded plat of Bellevue; also the first north-south alley east of <br /> Esther Street, running north from Hildreth Street, for a distance of <br /> approximately 564 feet to the south line of Ruskin Street, in the plats <br /> of Bellevue and John Adams first addition. <br /> STATEMENT OF PURPOSE AND INTENT <br /> Pursuant to Indiana Code Section 36-7-3-12, the Common Council is <br /> charged with the authority to hear all petitions to vacate public ways or <br /> public places within the City. <br /> The following Ordinance vacates the above described public property. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, as follows: <br /> SECTION I . The Common Council of the City of South Bend having held <br /> a public hearing on the petition to vacate the following property: <br /> All that part of an existing east-west 14 foot alley lying <br /> between the north line of Lots #105, 106 and 107, and the south <br /> line of Lot #104 in the recorded plat of Bellevue, said alley <br /> being approximately 120 feet in length, and including (2) <br /> platted 5' x 5' corner cuts, and containing at total of 1,705 <br /> square feet, more or less, also: commencing at a point on the <br /> intersection of the centerline of an existing 20 foot alley and <br /> the east line of Esther Street, said point being north from <br /> the intersection of the north line of Hildreth Street and the <br /> east line of said Esther Street a distance of 271.8 feet, <br /> more or less; thence easterly parallel with the north line of <br /> Lot #102 in the plat of Bellevue, on and along said alley <br /> centerline, a distance of 120 feet, more or less to the west <br /> line of an existing north/south 16 foot alley. Said <br /> description includes all property lying 10 feet either side of <br /> the above described centerline and containing 2,400 square <br /> feet, more or less, also: commencing at the northwest corner of <br /> Lot #4 in the plat of John Adams first addition, said point <br /> also being the intersection of the south line of Ruskin <br /> Street and the east line of Esther Street; thence easterly <br /> along said south line of Ruskin Street a distance of 128 <br /> feet, more or less to the centerline of an existing 16 foot <br /> wide alley, the true point of beginning of this description; <br /> thence southerly along said centerline a distance of 297 feet, <br /> more or less to a point located on the original south line of <br /> Harriet Street, now vacated; thence westerly along said south <br /> line, a distance of 1 foot to the centerline of an existing 14 <br /> foot wide alley; thence southerly along said centerline, a <br /> distance of 266.8 feet to the north line of Hildreth Street, <br /> the terminus of this description, said 16 foot alley containing <br /> 4,752 square feet, and said 14 foot alley containing 3,735.2 <br /> square feet and totaling 8,487.2 square feet, more or less. <br />
