Sec. 21-108 . -Same-Jurisdiction; Appeals; notice. <br /> (a) Appeal from the ruling of the Building Commissioner concerning <br /> the enforcement of the provisions of this chapter may be made to the <br /> Board of Zoning Appeals within such time as prescribed by the Board by <br /> general rule. <br /> (b) The appellant shall file with the Building Commissioner and <br /> with the Board of Zoning Appeals a notice of appeal, specifying the <br /> grounds thereof. The Building eCommissioner shall immediately <br /> transmit to the Board all the papers constituting the record upon which <br /> the action appealed from was taken. <br /> Sec. 21-109. Board of Zoning Appeals; jurisdiction; variances. <br /> (a) In specific cases the Board of Zoning Appeals has jurisdiction <br /> to permit the following: <br /> ( 1) Permit a temporary building for commerce or industry in a <br /> residential district which is incidental to the residential <br /> development, such permit to be issued for a period of not more than one <br /> ( 1) year. <br /> ( 2) Permit the continuance of a legal nonconforming use <br /> existing at the time of the passage of this chapter that has ceased for <br /> a period of one ( 1) year; provided the owner of the building or <br /> premises devoted to the use can show proof that the intent was not to <br /> discontinue the nonconforming use of the building or premises. <br /> ( 3) Permit the reconstruction, within twelve ( 12) months, of <br /> a building located in a district restricted against its use, which has <br /> been destroyed by fire, flood, explosion, war, riot or act of God to <br /> the extent of not more than fifty ( 50) percent of its value; provided <br /> that when such reconstruction becomes involved in litigation, the time <br /> required for such litigation shall not be counted as a part of the <br /> twelve (12) months allowed for reconstruction. <br /> ( 4) Permit the extension of a use or height and area district <br /> for a distance of not more than twenty-five ( 25) feet, where the <br /> boundary line of a district divides a lot in a single ownership at the <br /> time of the passage of this chapter Ordinance No. 4990-68. <br />
