f58}(115) Yards side; means epen-spaee a yard between <br /> the building and the side line of the lot. <br /> Sec. 21-2. Enforcement of chapter; appeals. <br /> The Building Commissioner shall see that this chapter is enforced <br /> through the proper legal channels. Appeal from the decision of the <br /> Building Commissioner may be made to the South Bend Board of Zoning <br /> Appeals as provided by Article 6 of this chapter. <br /> Sec. 21-3. Plat Site plan submission; records; restriction.. <br /> (a) All applications for building permits shall be accompanied by <br /> a plat site plan in duplicate drawn to scale, showing the actual <br /> dimensions of the lot to be built upon the size of the building to be <br /> erected, and such other information as may be necessary to provide for <br /> the enforcement of this chapter. <br /> (b) A careful record of such applications and plats site plans <br /> shall be kept in the office of the Building Commissioner. <br /> (c) No yard, eeurtcourtyard or other open space provided <br /> abeataround any building for the purpose of complying with the <br /> provisions of this chapter shall again be used as a yard, <br /> eeurtcourtyard. or other open space for another building. <br /> Sec. 21-4. Conflicts with chapter, interpretation. <br /> (a) Private covenants. This chapter shall not interfere with or <br /> abrogate or annul any easements, covenants or other agreements between <br /> parties; provided, however, that where this chapter imposes a greater <br /> restriction upon the use of buildings or premises or upon heights of <br /> buildings, or requires larger open spaces than are imposed or required <br /> by other ordinances, rules, regulations or permits, or by easements, <br /> covenants or agreements, the provisions of this chapter shall govern. <br /> (b) Flood hazard areas.
