(b) Using a portion of the building for dwelling units pursuant to <br /> Subsection (a) will not impose Residenee Residential. District <br /> standards or restrictions upon the remainder of the "C" Commercial <br /> District. <br /> Sec. 21-117.07 . Commitments; Recording. <br /> (a) The Board may permit or require an owner of a parcel of <br /> property requesting an exception or a variance to make a written <br /> commitment concerning the use or development of that parcel pursuant to <br /> Indiana Code Section 36-7-4-921 (Burns 1986) . <br /> (b) The Board may require that any variance, exception, <br /> certificate of non-conforming use, interpretation or commitment be. <br /> recorded in the St. Joseph County Recorder' s office. <br /> Sec. 21-122 Zoning of Annexed Areas <br /> (a) Each area annexed to the City after the effective date of this <br /> provision (July 24,1972) shall be zoned "A" Residence <br /> District and "A" Height. and Area. District as of the date of <br /> annexation. <br /> (b) Within sixty (60) days after notification of th date of <br /> annexation of an area hereafter annexed to the City, the <br /> Commission shall submit to the Council a recommended zoning <br /> plan for such area. Within forty-five (45) days after receipt <br /> of such recommended zoning plan, the Council shall adopt by <br /> ordinance a zoning plan for such area. <br /> (c) No building permit shall be issued by the Building <br /> Commissioner and no change in use or bulk of structures <br /> existing may occur in any area hereafter annexed to the City <br /> until such area has been zoned by the Council, except that for <br /> lots of record in a recorded subdivision, building permits may <br /> be used for single-family dwelling units. <br />
