EX)FIIBIT C <br />STATEMENT OF PURPOSE AND INTENT <br />Petitioner is seeking to rezone the subject properties to Community Business District (CB) for the <br />purpose of constructing and operating a Walgreens Drug Store at the proposed location. A drug store is a <br />permitted use in a Community Business District, and rezoning of the property necessary to support the <br />store would not be inconsistent with the City of South Bend's City Plan and would be consistent with the <br />current and future use and development of the surrounding area. <br />CB zoning is appropriate for this location, as it is located in a commercial district where there are <br />numerous existing retail and service businesses that serve the surrounding area, including single-family <br />residences and a large apartment complex located directly adjacent to the subject property. <br />The parcel on the corner of Western and Lombardy is currently zoned CB. The other zoned <br />parcels are MF-1 (Urban Corridor Multi Family District) and LB (Local Business District); and a rezoning <br />of these parcels to CB will not be inconsistent with the use of the surrounding properties and will unify <br />the entire area for future use under a single zoning classification consistent with current use. <br />Concurrent with the filing of this Rezoning Petition, Petitioner will be filing an Application for <br />Minor Subdivision, to bring the subject properties under a single legal description and common use. If the <br />new legal description based upon the minor subdivision application, which incorporates the subject <br />properties, is not issued or otherwise approved prior to the approval of this Rezoning Petition, Petitioner <br />requests that the rezoning be approved as to each parcel individually as requested.
