The fact that a person may have been issued <br />a license by the State of Indiana to carry a handgun on the streets does not mean that person has to <br />be allowed to carry it into City buildings or onto other City property except highways as now defined <br />in the ordinance. <br />The signage requirement remains. As the purpose of that requirement is to provide notice, <br />I have amended to allow for successful enforcement or the ordinance if notice was given by some <br />alternative means. <br />Although the purpose of the original ordinance was partly public education, and this one is <br />grounded upon employee safety, I have not altered the portions of the penalties to eliminate <br />community service or classes, although the Police Department has never conducted such seminars <br />pursuant to this Chapter. Given the clearer and more restricted purpose of the amended ordinance <br />you may wish to reconsider classes as part of the punishment. I have left in community service. The <br />Council should be aware there could be constitutional problems if community service were regarded <br />as a form of imprisonment. The previous version was silent as to the amount of fine for the second <br />offense. I have inserted a figure, but of course you are free to adjust that. <br />Finally, the only change I have made in the "Return of Weapons" section is to allow for a <br />longer period of time before the Board of Public Safety sets a hearing. The Board of Public Safety <br />is subject to the "Open Door Law" and in certain circumstances could not have met the time limit <br />imposed by the previous ordinance. A request for return of weapon that was given to the Board of <br />Public Safety the day before Thanksgiving could not have been scheduled legally within the five day <br />time frame. <br />Your very prompt attention to this matter and the passage of this ordinance with such further <br />amendments as you may see fit will be appreciated.
