COUNCIL RULES SEPTEMBER 24,2012 <br /> 4:39 P.M. <br /> Committee Members Present: Derek Dieter, Dr. Fred Ferlic, Dr. David Varner, <br /> Karen White <br /> Other Council Present: Tim Scott, Henry Davis Jr., Val Schey, Oliver <br /> Davis, Gavin Ferlic <br /> Others Present: Kathy Cekanski-Farrand, Kevin Allen <br /> Agenda: 2012 Council President's Report <br /> Review of Henry Davis Jr.'s Complaint against Dr. Fred Ferlic <br /> The Council Rules Committee was called to order by President Dieter with two items <br /> posted for discussion. <br /> The first was the annual President's Report which Dieter announced would be continued <br /> and presented at a future meeting after the budget process was completed. <br /> The second item was an update on two open complaints filed by Councilmember Henry <br /> Davis. Mr. Davis' complaint against fellow Councilmember Dr. Fred Ferlic was <br /> investigated by Council Attorney Kathy Cekanski-Farrand and by the City's Legal <br /> Department. Kathy,provided a written report of the investigation(attached) explaining <br /> the findings found the complaint required no further action by the Council. While the <br /> complaint was serious,the surrounding facts were insufficient to proceed. The report <br /> was accepted by both Councilmembers Henry Davis Jr., and Dr. Fred Ferlic. <br /> The other pending complaint filed by Henry Davis against Chief Hurley had been <br /> referred to the City's Legal Department; but an opinion had yet to be filed. The Council <br /> asked the Council Attorney to request a report from the City. <br /> There being no further business to come before the committee at this time, Chairperson <br /> Derek Dieter adjourned the meeting at 4:10 p.m.4' .spect lly bmitted, i.
