Hickory <br /> Three bills were scheduled for consideration before Oliver Davis' Zoning &Annexation <br /> Committee. <br /> The first was Bill No. 37-12, a request to rezone 621 Lincoln Way East from small <br /> business to mixed use. This would allow the petitioner, Diane Erdman, to renovate a <br /> historic home to establish a sewing machine repair business on the first floor and rent the <br /> second floor as an apartment. Christa Nayder from Area Plan reported a favorable vote <br /> from the Commission and staff. Catherine Hostetler, Director of the Historic <br /> Preservation Commission submitted a letter in support of the request (A copy is on file in <br /> the Office of the City Clerk.) Following brief discussion, Dr. Varner moved the bill be <br /> sent favorably to Council. Gavin Ferlic seconded and all approved. <br /> Bill 35-12 would allow the City Council the option of declaring the old AVON theatre a <br /> historic landmark thereby preventing its demolition by the St. Joseph County Public <br /> Library wanting to expand on the site. At this point Oliver noted a request to continue <br /> the bill indefinitely to allow both the library board and the HPC to ratify a compromise <br /> agreed upon to allow demolition of the structure while saving the ceramic facade. <br /> Attorney James Masters explained the Memorandum of Understanding (MOU) between <br /> the parties. David Varner motioned the bill be continued until 10-22-12 allowing the <br /> respective boards time to rule on the MOU. Dr. Ferlic seconded and all supported. <br /> The last bill on the agenda, Bill No. 12-69, was a petition for a special exception to allow <br /> temporary additional parking for an expanding fitness center at 1311 Hickory Road. <br /> Mark Lyons from the building department reported that the BZA ruled favorably on the <br /> petition.
