B®A DF PUBLIC WCIRI~S s/Cpary Clilot, President s/Carl Littrell, Member s/Don Inks, Member ATTEST: s/Linda Martin, Clerk AD®PT S®LUTI®N ND. 13-200 - A RES®LUTI®N LATER TC~ ACQUISITI®N ®F' PROPERTY IN THE CITY ®F' SCDUTI~I BEND, INDIANA (NAP®LEI®N ST ET - L®T 32~ Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the following Resolution was adopted by the Board of Public Works: S®LUTI®N N®. 13-200 S®LUTI~N LATER TD ACQUISITI®N ®F PR®PERTY IN TIgE CITY ®F' SDUTPI BEND, INDIANA (NAP®LE®N ST ET - LDT 32) WIiE AS, the City of South Bend, Indiana (the "City'>) is a municipality for purposes of IC 32-24-29 d 1=IEREAS, the City has determined that it is necessary to open, change and layout a street located within the City, to-wit: Napoleon Street at and around its intersection with State Road 23 (the "Project"), which Project will serve a public purpose, be of benefit to the health or general welfare of the unit, and be in the best interest of the citizens of the City; and WPIE AS, pursuant to Indiana Code § 36-9-6-3 and Indiana Code § 36-1- 10.5-1, the City of South Bend, Indiana, Board of Public Works (the ABoard@) is the entity vested with the authority and power to acquire, receive, manage and care for the property of the City and to oversee the Project; and WI4E AS, in order to properly complete the Project it is necessary to acquire and the City wants to acquire the parcel of property set forth in Exhibit A (the `6RC)W Property")~ d WISE AS, the RDW Property is owned by the persons or entities set forth in Exhibit A; and WPIEREAS, the Board desires to authorize staff to present and negotiate offers for the R~}W Property on behalf of the Board subject to the Board's final approval of any negotiated purchase of the RDW Property; and WIdE AS, the acquisition of the RDW Property is not expected to exceed Twenty-five Thousand and 00/100 Dollars 025,000.00).
