BILL NO. ORDINANCE NO. $ 14' 7- 71 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 21 , ZONING, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED, BY ADDING NEW SECTIONS 21-11 .1 (b) AND 21-89.5 TO ALLOW HOSPITALS AND EMERGENCY MEDICAL CARE SERVICE CENTERS IN THE EAST BANK AREA OF THE CITY OF SOUTH BEND AS PERMITTED USES AND TO ESTABLISH THE OFF STREET PARKING SCHEDULE FOR THESE USES. WHEREAS, it has been determined that hospitals and emergency medical care service centers are appropriate land uses in the East Bank Area of the City of South Bend; NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: SECTION I . THAT ARTICLE 2, USE DISTRICT REGULATIONS, DIVISION 4.5 "A-3" MIXED USE MULTIFAMILY RESIDENTIAL AND COMMERCIAL DISTRICT be amended by adding the following new SECTION 21 .11 .1 (b) (3.5) : (3.5) Hospital uses: a. Hospitals which are not penal or correctional institutions, provided that : (1) The lot to be used is at least four (4) acres. (2) No part of any building shall be located less than fifty (50) feet from any bounding lot or street line, and b. Emergency medical care service centers. SECTION II . THAT ARTICLE 5, OFF STREET PARKING AND LOADING FACILITIES, DIVISION 2. SECTION 21-89.5 EAST BANK PARKING DISTRICT SCHEDULE be amended by adding the following new SECTION 21-89.5 (3.5) : (3.5) Hospital uses: Hospitals which are 1 per 4 beds, plus not penal or cor- 1 per 2 employees, plus rectional institutions. 1 per staff doctor. Emergency medical 1 per 2 employees, plus care service centers. 6 per staff doctor. Section III . This Ordinance shall be in full force and effect from and after its enactment, approval by the Mayor and publication as required by law.
