Ordinance No. rc q A <br /> Substitute Bill No. 56-12 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF SWORN <br /> MEMBERS OF THE SOUTH BEND POLICE DEPARTMENT FOR CALENDAR YEARS <br /> 2013 AND 2014 <br /> STATEMENT OF PURPOSE AND INTENT <br /> Pursuant to Indiana Code § 36-8-3-3,¶ (d), the South Bend Common Council, as the legislative <br /> body of a second class Indiana city, is charged with establishing before November 1st the annual <br /> compensation of members of the South Bend Police Department. <br /> On May 14, 2012, the South Bend Common Council unanimously adopted Resolution No. <br /> 4179-12 which appointed an agent/chief negotiator for the labor negotiations to work with the City <br /> Advisory Negotiating Team for Police Negotiations. The Council's Agent and the City Advisory <br /> Negotiating Team have been meeting with the Police Negotiating Team representing sworn members <br /> of the Fraternal Order of Police South Bend Lodge No. 36. <br /> The City Advisory Negotiating Team's membership includes Council Member at Large Karen <br /> L. White, 1St District Council Member Tim Scott, Council Member at Large Gavin Ferlic (Alternate), <br /> City Controller Mark Neal, Uniform Division Chief Jeff Walters, and Division Chief for Services Gary <br /> Horvath; with Kathleen Cekanski-Farrand serving as the Council's Agent and Ed Sullivan serving as <br /> the Board of Public Safety's Agent. <br /> The Fraternal Order of Police South Bend Lodge No. 36 Negotiating Team includes 3rd Detail <br /> Lieutenant and FOP President Steven G. Noonan, 1st Class Patrolman (Police Special Crimes) James <br /> M. Taylor, 31-d Detail Sergeant Daniel S. Moryl, 1St Detail Sergeant James M. Wolff, 1st Detail Sergeant <br /> William G. Kraus, Sergeant Daniel D. Demler, Jr., Police K-9 Unit, and their attorney Leo T. <br /> Blackwell. <br /> This ordinance sets forth the recommended salaries and monetary fringe benefits to be paid to <br /> sworn members of the South Bend Police Department for calendar years 2013 and 2014. Recognition. The South Bend Common Council recognizes the Police Negotiating <br /> Team which represents the Fraternal Order of Police, Lodge No. 36 as the sole bargaining agent for the <br /> sworn members of the South Bend Police Department, for purposes of negotiating annual pay and <br /> monetary fringe benefits which are addressed in this ordinance, excepting the Police Chief, Division <br /> Chiefs and Captains who are governed by Indiana Code § 36-8-1-12. <br />
