• i <br /> • <br /> BILL NO, <br /> ORDINANCE NO. 1 1 4 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,INDIANA, <br /> AMENDING CHAPTER 14 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND BY THE <br /> INCLUSION OF NEW ARTICLE 2 ENTITLED"PUBLIC SAFETY REQUIREMENTS FOR <br /> RESIDENTIAL SWIMMING POOLS", AND AMENDING CHAPTER 2, ARTICLE 19, SECTION 2- <br /> 213 COMMONLY KNOWN AS"SCHEDULE OF ORDINANCE AND CODE VIOLATIONS." <br /> STATEMENT OF PURPOSE AND INTENT <br /> The Common Council believes that reasonable public safety requirements are <br /> necessary to address residential swimming pools. <br /> Residential swimming pools are permitted accessory uses within our City. The <br /> following Ordinance would incorporate requirements addressing safety ladders and <br /> barriers, which are believed to be in the public interest. <br /> This Ordinance also provides for a monetary penalty of twenty-five dollars <br /> ($25.00) payable through the Ordinance Violations Bureau if a person fails to comply <br /> with these safety requirements. <br /> This Ordinance would also add a violation of this Article to the "Schedule of <br /> Ordinance and Code Violations", which are payable to the Ordinance Violations <br /> Bureau. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, as follows: <br /> SECTION I. Chapter 14 of the Municipal Code of the City of South Bend, Indiana, is <br /> hereby amended by the inclusion of new Article 2, which shall read in its entirety as <br /> follows: <br /> Chapter 14. Specific Public Safety Regulations. <br /> Article 2. Public Safety Requirements for Residential Swimming Pools. <br /> Sec. 14-10 Compliance Required. <br /> (a) All residential swimming pools defined as any artificial body of water of <br /> permanent or temporary construction that are constructed, installed, or <br /> maintained with a filtered controlled water supply in the ground. or above the <br /> ground with the capacity for water containing forty-eight (48) inches or more <br /> in depth at any point, and which are used or intended to be used solely by the <br /> owner, tenant. or occupant of the building in the lot where located and by the <br /> family, friends, guests of such owner, tenant, or occupant, and which are <br /> located in an "A" residential area, shall be required to comply with the <br /> provisions of this Article, <br /> (b) It shall be unlawful for any owner. tenant. or occupant to erect or causes <br /> to be erected. or puts into usage or causes to be put into usage. any residential <br /> swimming pool, as defined herein, except in compliance with the provisions of this <br /> Article. <br /> Sec. 14-11 Safety Requirements. <br />
