z � <br /> Personnel and Finance Committee <br /> 2005 South Bend Common Council <br /> The May 23, 2005 meeting of the Personnel and Finance Committee was called to order by its <br /> Chairperson, Council Member Roland Kelly at 3:46 p.m. in the Council Informal Meeting <br /> Room. <br /> Persons in attendance included Council Members Dieter, Pfeifer, Puzzello, Kelly, Varner, <br /> Kuspa, White and Rouse; Citizen Member Martha Lewis, Charlotte Sobel, Rita Kopala, City <br /> Controller M. Catherine Fanello, Brad Poulan, Executive Director of the Department of <br /> Community and Economic Development Sharon Kendall, City Clerk John Voorde and Kathleen <br /> Cekanski-Farrand, Council Attorney. <br /> Council Member Kelly noted that the Committee Members present included Council Members <br /> Varner,Kuspa, and himself as Chairperson. Council Member Kelly then called for a presentation <br /> on Bill No. 29-05 which would amend Chapter 2, Article 14 of the South Bend Municipal Code <br /> by adding new Section 2-170.8 addressing a property levy excess fund(copy attached). <br /> City Controller M. Catherine Fanello made the presentation. She stated that this is required by <br /> Indiana Code 6-1.1-18.5-17. Because the city has received excess tax distribution the creation <br /> of the fund is necessary. The fund will be the repository for taxes collected in any calendar year <br /> that exceed the ad valorem property tax levy which would have been approved by the local <br /> government finance. She noted that Mishawaka is in the same situation. Monies will be <br /> transferred into the fund and then transferred to the respective funds. <br /> Council Member Kelly inquired how much money would be affected. <br /> Ms. Fanello passed out a 1-page handout which showed that in 2003 the city received $800,624 <br /> and in 2004 the city received $728,199 in excess levy funds. She noted that this will have the <br /> effect of reducing the budget. In response to a question from Dr. Varner, Ms. Fanello stated that <br /> this has never happened before and is new to most cities. It resulted from the delay in tax <br /> distributions and a recovery of more delinquent tax payments. 102% of the certified levy used to <br /> be certified now the maximum is 100%. <br /> Council Member Kuspa made a motion, seconded by Dr. Varner that Bill No. 29-05 be <br /> recommended favorably to Council.
