MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY OF SOUTH BEND AND <br />TEAMSTERS LOCAL UNION NO.364 <br />This Memorandum of Understanding (this "MOU") is made on <br />November 17 , 2020 (the "Effective Date") and sets forth the agreement between the <br />City of South Bend, Indiana (the "City"), and Teamsters Local Union No. 364 , affiliated with <br />the International Brotherhood of Teamsters of America ("the Union") (collectively, the <br />"Parties"). <br />RECITALS <br />WHEREAS, the Parties entered into a Master Agreement ("Agreement") to provide for <br />equitable and peaceful adjustment of differences which may arise, further a mutual and voluntary <br />effort to promote and maintain sound labor relations, and to establish other conditions of <br />employment for the calendar years 2017-2020; and <br />WHEREAS, the Common Council of the City of South Bend, Indiana ("Common <br />Council") passed Ordinance number 7997-89 on July 24, 1989, fixing the maximum wages and <br />monetary fringe benefits for Union employees of the City for the calendar years 1990 through <br />1992. Further, each subsequent three-year cycle, the Common Council has passed an ordinance <br />fixing the maximum wages for Union employees, most recently on October 24, 2016 in <br />Ordinance No. 10474-16 for the term commencing on January 1, 2017 through December 31, <br />2020. <br />WHEREAS, the Parties acknowledge that the full monetary impact of COVID-19 is <br />uncertain, but the Parties agree that the pandemic, as well as the efforts to maintain government <br />functions and services during the associated quarantine period will cause shortages in the City <br />budget for 2020 and beyond. <br />Wl IEREAS, the Parties plan to engage in more fully informed collective bargaining in <br />2021. Thus, the Parties wish to enact the clause from Article 33 of the 2017-2020 Agreement, <br />allowing the contract terms to "continue in full force and effect for one (1) year...," extending <br />the current terms through December 31, 2021. <br />NOW, THEREFORE, in keeping with the purpose of the Agreement to promote and <br />maintain sound labor relations in the best interests of the community, and in the respective best <br />interests of the Parties, the City and the Union agree as follows: <br />1. Under Article 33 of the Agreement, the current Agreement, and all of its agreed <br />upon supplements are in full force and effect for an additional one (1) year term. The Agreement <br />terms are now scheduled to expire on December 31, 2021. <br />
