THE FIlZST ALLEY TO BE VACATED IS THE FIRST NORTH/SOUTH <br />ALLEY EAST OF LAFAYETTE BLVD., FROM THE NORTH RIGHT OF <br />WAY LINE OF BARTLETT STREET TO THE VACATED EAST/WEST <br />ALLEY FOR A DISTANCE OF 269.5 FEET AND A WIDTH OF 14 FEET. <br />THE SECOND ALLEY TO BE VACATED IS THE FIRST NORTH/SOUTH <br />ALLEY WEST OF MICHIGAN STREET (SR 9332, FROM THE NORTH <br />RIGHT OF WAY LINE OF BARTLETT STREET TO THE SOUTH RIGHT OF <br />WAY LINE OF PARK LANE. FOR A DISTANCE OF 469 FEET AND A <br />WIDTH OF 14 FEET. THE THIRD ALLEY TO BE VACATED IS THE FIRST <br />EAST/WEST ALLEY NORTH OF BARTLETT STREET FROM THE EAST <br />RIGHT OF WAY LINE OF MAIN STREET TO THE WEST RIGHT OF WAY <br />LINE OF MICHIGAN STREET (SR 933), FOR A DISTANCE OF 344 FEET <br />AND A WIDTH OF 14 FEET. <br />hereby determines that it is desirable to vacate said property, and that the same is <br />vacated. <br />SECTION II. The City of South Bend hereby reserves the rights and easements of all <br />utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, <br />including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water <br />control structures and ditches, within the vacated right-of--way, unless such rights are released by <br />the individual utilities. <br />SECTION III. The following property may be injuriously or beneficially affected <br />by such vacating: <br />Part of Bank Out Lot Numbered 124 of the Third Plat of Out Lots of the Town, <br />now City of South Bend platted by the State Bank of Indiana; Lots 32, 33, 34, 35, <br />36, 37, 38 and 39 in Bartlett's Second Addition; Lots 15, 16, 17, 18, 29, 30 and 31 <br />in Bartlett's Addition; Lots 1, 2, 3, 12, 13, 14, 15, 16, 28 and 29 in Reynold's <br />Addition and Lots 1, 2, 3, 4, 5, 6, 7, 12, 13 and 14 in Vinson's Addition.. <br />SECTION IV. The purpose of the vacation of the real property is to: <br />Facilitate the development of the property East, West and South of said alleys and streets <br />to facilitate the development of the property and to facility the vacation and construction of <br />relocated Bartlett Street across this property to construct a new entrance to Memorial Hospital <br />across that property. <br />
