FANG LOT LE,4SE <br />THIS LEASE WITNESSETI-I: THAT, SOLrTH BEND PARKS AND RECREATION <br />DEPARTMENT, through its BOARD OF PARK COMMISSIONERS, Lessor, does hereby lease <br />to RESCUE INC., Lessee, far use as a parking lot and for no other purpose the area located <br />immediately northwest of the intersection of South Street and Lafayette Boulevard in South <br />Bend, Indiana, shown on Lots ~9, 70, 71, and 72 in the attached Exhibit "A", which exhibit is <br />made a part hereof. <br />The Lessee shall have and hold the demised premises for a tarn of One (1) year, <br />commencing on the ly` day of January, 2003 and ending on the 31S` day of <br />Deceanber, 2003. <br />2. Lessee agrees to pay Lessor at its principal offices at: 321 East ~Talter Street, <br />South Beztd, Indiana, 4ti614, or at such place or places as Lessor from time to <br />time shall designated in writing. Rent shall be in the amount of $204.04 per <br />month, payable on the I"day of each month for that month. <br />3. Saari Lessee shall not assign said lease or sublet all or any portion of said premises <br />without the prior written consent of the Lessor in each instance. In the event of <br />any such transfer or assignment of said lease or subletting of all ar any part of said <br />premises, said Lessee shall not be entitled to be relieved from the obligation of <br />this lease. <br />4. The parking provided under this Lease shall be available only to the staff and <br />residents of Lessee's facility at 432 South Lafayette Strcct, South Bend, Indiana, <br />and only from the hours of 7:00 a.m. unti15:30 p.m. each day. Further, use of the <br />premises by Lessee is prohibited during the following periods: <br />A. On all days in which South Henri Silverhawks play day games, <br />provided two (2) weeks written notice is given to Lessee; <br />H. June 29`~ through and including July 4~' of each year; <br />C. For the weekend designated "Summer itt the City" from 3:00 p.m. <br />on Friday through 7:00 a.m. the following Monday, providing <br />Lessee receives at least one month prior written notice; and <br />D. Such other dates, not to exceed seven (7) in any calendar year, for <br />which Lessor determines that events planned far Covcleski <br />Stadium require the use of the facility, providing that Lessee <br />receives at ]east two (2) weeks written notice. <br />5. The Lessee will at its own expense keep and maintain the premises free and clear <br />of all snow and ice. Lessor shall be responsible for clearing the grounds of debris <br />following Silverhaw•k Games and other events at Coveleski Stadium. The Lessee <br />shall not make any structural alterations or additions to th.e premises without the <br />written consent of Lessor first obtained. Lessor shall provide signage indicating <br />that parking is reserved for staff and residents of 432 South Lafa}~ette Street, <br /> <br />
