ORDINANCE NO. ~ ~°~"~3 <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING CHAPTER 2, ARTICLE 8, SECTION 2-121 OF THE <br />SOUTH BEND MUNICIPAL CODE CLARIFYING HOLIDAYS FOR <br />CITY OFFICERS AND EMPLOYEES <br />STATEMENT OF PURPOSE AND INTENT <br />In those years that New Year's Day falls on a Saturday or Sunday it is appropriate for the <br />Board of Works to designate a preceding or succeeding weekday to provide the paid holiday for City <br />officers and employees. This may affect the allocation of nine designated holidays per year in those <br />years that New Year's Day falls on a Saturday. This Ordinance is intended to clarify that such a <br />substitution shall not affect the nine (9) day designated holiday maximum. <br />It is also appropriate to expand the choice ofnon-designated holidays from which officers <br />and employees are entitled to select one day. Accordingly, this Ordinance adds Election Day and <br />Easter Monday to the list of non-designated holidays. It also provides substitutes for the non- <br />designated holidays of Christmas Eve and the Day after Christmas in those years when Christmas <br />falls on a Saturday or Sunday. <br />BE IT THEREFORE ORDAINED by the Common Council of the City of South Bend, <br />Indiana as follows: <br />Section I. Chapter 2, Article 8, Section 2-121 of the South Bend Municipal Code be and <br />hereby is amended to read as follows: <br />(a) Officers and employees shall receive nine (9) designated holidays as approved by the <br />Board of Public Works and one (1) additional nondesignated holiday. An officer or <br />employee may choose to substitute this additional holiday for one (1) of the following <br />nondesignated holidays: <br />Martin Luther King Day <br />President's Day <br />Columbus Day-Observed <br />Christmas Eve~or the preceding Frida when Christmas falls on a Sunday <br />Day after Christmas, or the following_Monday when Christmas falls on a Saturday <br />Employee's Birthday <br />Easter Monday <br />A religious holiday of the employee's choosing <br />Election Day (Primary or General) <br />
