At the meeting, the Commission <br /> placed the Avon Theatre under interim protection under the authority granted by the Municipal <br /> Code of the City of South Bend, Indiana, (the "Code") Section 21-13.02(d)(5). <br /> Bill 35-12 was introduced by the Common Council on July 23, 2012. Pursuant to the <br /> Code, Section 21-13.02(d)(4), the matter was referred to the Commission to hold a public <br /> hearing for the purpose of making a recommendation to the Common Council concerning Bill <br /> No. 35-12. <br /> On September 17, 2012, the Commission held a public hearing after publication of notice <br /> of the time, date and place of the public hearing. At the public hearing, the Commission heard <br /> public comments both for and against the designation of the Avon Theatre as a Local Historic <br /> Landmark. <br /> After hearing all comments offered by the public, and after giving the owner of the Avon <br /> Theatre an opportunity to make a final statement, and after discussion by the members of the <br /> Commission, the Commission adopted a Resolution making a favorable recommendation to the <br /> CHERYL A.
