SOUTH BEND.INDIANA 46601 (574)23S-9571 <br /> Wednesday, October 17,2012 06 ' <br /> The Honorable Council of the City of South Bend <br /> 4th Floor,County-City Building <br /> South Bend, IN 46601 <br /> RE: A proposed ordinance Initiated by the Common Council of the City of South Bend, Indiana,amending Chapter <br /> 21 of the South Bend Municipal Code Article 2, Residential Districts,to allow the raising and care of chickens <br /> as an accessory use;and adding certain related definitions,as amended,City of South Bend-APC#2618-11. <br /> Dear Council Members: <br /> I hereby Certify that the above referenced ordinance of Honorable Council of the City.of South Bend, Indiana <br /> was legally advertised on Thursday, October 04, 2012 and that the Area Plan Commission at its public hearing <br /> on Tuesday, October 16,2012 took the following action: <br /> Upon a motion by John McNamara, being seconded by Donna Chamblee <br /> and carried, the proposed ordinance Initiated by the Common Council of the <br /> City of South Bend, Indiana, amending Chapter 21 of the South Bend Municipal <br /> Code Article 2, Residential Districts, to allow the raising and care of chickens as <br /> an accessory use; and adding certain related definitions, as amended, is sent to <br /> the Common Council with a favorable recommendation. The policy decision as <br /> to whether or not to allow the keeping of chickens within the city limits rests with <br /> the elected officials. In the event that these officials determine that chickens should <br /> be allowed, it is the Commission's opinion that this ordinance provides reasonable <br /> protection to adjacent properties, by establishing appropriate development standards, <br /> a process for permitting, and consequences of violating the ordinance. <br /> PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the <br /> Common Council's first reading.
