• New Employee/Applicant means a person who has not <br />been previously tested by BCRC and includes a person <br />referred for pre -employment testing. <br />NOF or Not on File means that an Employee is not <br />currently entered into the BCRC database as an <br />Employee eligible for and subject to the BCRC Policy <br />when used with respect to the BCRC status of an <br />Employee. (NOTE: An Employee can be NOF for <br />several reasons, which may include failure to provide <br />documentation that the Employee is eligible for and has <br />agreed to be subject to the BCRC Policy.) <br />Non -Compliant Event means any of the following. <br />(a) a Positive Test for alcohol or drugs (which shall <br />also include any Positive Tests that occur during any <br />retesting), (b) an Insufficient Specimen if an <br />appropriate medical professional determines that <br />there is no legitimate medical reason for the <br />Insufficient Specimen, (c) a Diluted Specimen if the <br />Employee fails to provide a subsequent testing <br />sample within the applicable time period specified <br />in this Policy or a subsequent testing sample is also a <br />Diluted Specimen, (d) an Adulterated Specimen, <br />(c) a Substituted Specimen, (f) an Out -of - <br />Temperature Specimen that is not promptly resolved <br />by providing a compliant sample at the time that <br />the specimen is obtained at the collection site, <br />(g) any acts by an Employee that compromise the <br />testing protocol (i.e., washes his/her hands, flushes <br />the toilet, etc.) prior to being given direction from <br />the collection professional, (h) a Refuse To Submit <br />(to an alcohol or controlled substances test), (i) a <br />failure to submit to Post-Accident/Incident Testing <br />(which shall include a failure to test resulting from <br />the Employee leaving the jobsite prior to such <br />Post-Accident/Incident Testing), and 0) any other <br />13 <br />
