• 3 <br />} <br />i <br />ORDINANCE NO. gas 4 -Q � <br />AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED <br />PROPERTY: THE 1ST EAST -WEST ALLEY NORTH OF CEDAR <br />STREET, RUNNING EAST FROM ST. PETER STREET, FOR A <br />DISTANCE OF APPROXIMATELY 345 FEET TO NOTRE DAME <br />AVENUE, ALL IN CHAPOTON PLACE SUBDIVISION OF <br />COTTRELL'S ADDITION TO LOWELL, AND ST. PETER STREET, <br />FROM MINER STREET RUNNING, SOUTH TO CEDAR STREET, <br />FOR A DISTANCE OF APPROXIMATELY 322 FEET. <br />STATEMENT OF PURPOSE AND INTENT- <br />Pursuant to Indiana Code Section 36- 7 -3 -12, the Common Council <br />is charged with the authority to hear all petitions to vacate public <br />ways or public places within the city. <br />The following ordinance vacates the above described public <br />property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, as follows: <br />SECTION I. The Common Council of the City of South Bend <br />having held a public hearing on the petition to vacate the <br />following property: <br />A parcel of land located in the East Half (E1/2) of the <br />Southeast Quarter (SE1 /4) of Section One (1), Township <br />Thirty Seven (37) North, Range Two (2) East and all being <br />in Portage Township, City of South Bend, St. Joseph <br />County, Indiana, and being a part of the right of way of <br />a public street now known as St. Peter Street and a 12.00 <br />feet wide east /west alley and being more particularly <br />described as follows: <br />Beginning at the intersection of the north right of way <br />line of a public street now known as Cedar Street with <br />the west right of way line of a public street now known <br />as St. Peter Street, said Point of Beginning being the <br />southeast corner of Lot No. 17 as shown on the Recorded <br />Plat of Listenberger's Subdivision, thence north, along <br />the west right of way line of said St. Peter Street and <br />also being along the east line of Lots 16 and 17 of said <br />Listenberger's Subdivision a distance of 222.0 feet, <br />thence east along the south line of Miner Street, <br />extended, a distance of 66.0 feet to the point of <br />intersection of the south line of Miner Street with the <br />east line of said St. Peter Street and also being the <br />northwest corner of Lot No. 11 of the Replat of <br />Chapoton's Subdivision of Large Outlot No. 2 of <br />Cottrell's Addition to Lowell as recorded in Plat Book <br />No. 5, Page 68; thence south, along said east right of <br />way line of St. Peter Street, a distance of 222.0 feet, <br />more or less, to the intersection of said east right of <br />way line with the north right of way line of said Cedar <br />Street, said point of intersection also being the <br />southwest corner of Lot No. 10 of said Chapoton's <br />Subdivision, thence west, along the north right of way <br />line of said Cedar Street, a distance of 66 feet to the <br />Point of Beginning of this description and containing <br />0.34 acre, more or less. <br />ALSO: <br />
