Section 1. The designation of Local Historic Landmark pursuant to St. Joseph Ordinance # 127- <br />78 for the real property and appurtenances located at 60649 Hickory Road South Bend Indiana <br />46614 is hereby repealed pursuant to section 21-21.04(b)(4)(D) of South Bend Municipal Code. <br />Section II. This ordinance shall be in full force and effect after its passage by the Common <br />Council, approval by the Mayor, and publication as required by law." <br />Legal Counsel Kennedy stated that the bill still needs second and third reading, which should happen at <br />the September 28`x' meeting, at which time she will notify them whether it has received a <br />favorable recommendation. She will be present at those meetings. <br />Legal Counsel Kennedy stated that in the July meeting, Commission Andrews made a motion and it was <br />seconded by Commissioner Brazinsky stating that the Commission was not opposed to delisting <br />of this landmark, and it was passed by a vote of 8 — 0. <br />PUBLIC DISCUSSION: <br />Mr. Ben Modlin (60649 Hickory Road, South Bend, IN 46614) stated that he was in favor of repealing <br />this ordinance. <br />Commissioner Wyncott made a motion to send Bill 36-20 to the Common Council with a favorable <br />recommendation. Seconded by Commissioner Andrews. <br />Six in favor, none opposed. <br />Vote: 6 — 0. Motion to send Bill 36-20 to the Common Council with a favorable recommendation <br />passes. <br />IV. PRIVILEGE OF THE FLOOR <br />N/A <br />V. REGULAR BUSINESS <br />A. APPROVAL OF MINUTES <br />Specialist Toering clarified that edits were made by Secretary Andrews to both sets of <br />minutes. <br />i. July 20, 2020 <br />Commissioner Andrews made a motion to adopt the July 20, 2020 minutes. <br />Seconded by Commissioner Stalheim. <br />Six in favor, none opposed. <br />Vote: 6 — 0. Motion to accept the July 20, 2020 minutes passes. <br />ii. August 17, 2020 <br />Commissioner Andrews made a motion to adopt the August 17, 2020 <br />minutes. Seconded by Commissioner Stalheim. <br />Six in favor, none opposed. <br />Vote: 6 — 0. Motion to accept the August 17, 2020 minutes passes. <br />
