This written program must be filed with the Illinois agency and <br />made publicly available. <br />Any Employee who violates the drug policy, tests positive for <br />drugs, or refuses to submit to a drug test may not work on a <br />public works project until the Employee satisfies the following <br />conditions: (1) the Employee has tested negative for presence of <br />drugs and is not under the influence of alcohol; (2) the Employee <br />has been approved to return to work in accordance with the <br />Employer's written substance abuse prevention program; and (3) <br />the testing for drugs and alcohol was conducted in accordance <br />with laboratory testing and Chain of Custody procedures as <br />required by the U.S. Department of Health and Human Services. <br />Upon meeting these conditions, an Employee may return to <br />work if qualified work remains. <br />ror further reference, the Substance Abuse Prevention Program <br />Requirements maybe found at 820 ILCS 265/10, 820 ILCS <br />265/15, and 820 ILCS 265/20; available at httplhvww.ilga.gov/ <br />legislation/ilcs/ilcs3.asp?ActID=2950&ChapterID=68 <br />43 <br />
