1.'"•?' • ORDINANCE NO. 8174- 9 a AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED "ZONING" STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to amend Chapter 21 of the Municipal Code to add private, nonprofit clubs as a permitted use in the "A-3" Zoning District , and to better define the permitted A-3 Retail and Business uses. NOW , THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I . Section 21 .11 .1 of Division 4.5 of Article 2 of Chapter 21 of the South Bend Municipal Code is amended to read as follows: Sec . 21 .11 .1 . "A-3" Mixed Use Multifamily Residential and Commercial District . (a) The intent of this section is to establish a zoning district in which to permit mixed use multifamily residential and business commercial to complement the central city area. (b) Permitted uses: (1) Residential uses: a. Apartment and boarding houses. b . Dwellings, multi- and two-family. c . Dwellings, single- , two-, or multifamily, when such dwellings are located in the same building as other permitted uses. (2) Commercial uses. a. Retail businesses, not including vehicle or boat sales, service, or repair establishments; recreational vehicle dealers; fuel dealers; or any retail establishments with outside sales or storage. b . Sporting goods stores, with or without ancillary rental of equipment . c . Hotels and motels. d . Parking garages. e. Restaurants, not including drive-ins. f . Class A cabarets. Establishments for the sale of beer or intoxicating liquor for consumption on the premises. h . Personal services. i . Professional services. (3) Office uses: a. Professional b . Medical c .
