Our City's evolution from its <br /> colonial beginnings through the Civil War years and beyond, evoke memories of how our <br /> "founding fathers" exercised power in a responsible, democratic, intelligent, and efficient <br /> manner. <br /> The Common Council recognizes that on May 8, 1865, a petition, signed by 286 <br /> individuals was filed with the Town Trustees seeking an election on the question of <br /> whether the area should incorporate as a City. The election was held on May 22, 1865, <br /> with the vote being in favor of becoming a City. <br /> The City of South Bend adopted a form of City Seal in 1865. The City Seal is used on all <br /> forms of official City documents and memorabilia. <br /> A four-member committee has studied South Bend's original City Seal, and has concluded <br /> that three(3) changes are in order: <br /> (1) That the American Flag be depicted as being flown from left to right since <br /> proper flag etiquette provides that the blue field be at the left when being displayed; <br /> (2) That the American Flag have thirty-five (35) stars, 13 stripes, and that the <br /> Liberty Cap appear on the top of the flag pole, as it did in 1865; and <br /> (3) That the original "cross formations" be depicted instead of the stars on each <br /> side of the "1865", in order to restore the Seal's original design. <br /> The City believes that these changes are important in order to properly reflect and capture <br /> the historic qualities of South Bend's original City Seal. <br /> 1/.013u, Vitr fors, 1ft It 'J;rbaittizti CBI/ Z (Common outtttl of Int (ttti of <br /> 0outil IBtttr, lntitatta, as Wow: <br /> Ottti0tt 3. Section 1-5 of Chapter 1 of the Municipal Code of the City of South Bend, <br /> Indiana, is hereby amended in its entirety to read as follows: <br /> (a) The City Seal of the City of South Bend shall be depicted as follows: The <br /> Seal shall be circular in shape. The outer circle shall have inscribed the words and figures, <br /> "The City of South Bend, Indiana, 1865", with a cross formation on each side of the <br /> "1865". The inner circle shall have an impress of the American Flag of 1865 with 35 stars <br /> thereon, with the flag being unfurled so that the blue field of the flag is at the left when <br /> displayed; and the flagstaff shall have the Liberty Cap atop it. The word "Peace" shall be <br /> inscribed at the position where the flag and flagstaff join. The background of the inner <br /> circle shall have an impress of the rising sun and the sun's rays near the bottom thereof <br /> partially surrounded by cloud formations. <br /> (b) The City-Clerk shall be the official custodian of the City's Seal and affix it <br /> to such books, papers,documents and instruments as required. <br /> 'ltat0tt U.
