• <br /> on Familial Status. <br /> The denial of. housing rights and opportunities based on familial <br /> status as prohibited by this article shall not apply to housing <br /> intended for and solely occupied by persons over 62 years of age <br /> or older or which is designed and operated to assist elderly <br /> persons under a federal or state program. <br /> If there are persons living in such housing under age 62, this <br /> exception applies provided that: <br /> (a) All occupants after September 13, 1988. are at least 62 <br /> years old; <br /> (b) Any unoccupied units are reserved for occupancy by <br /> persons at least 62 years old; and <br /> (c) Any persons under age 62 occupying said housing after <br /> September 13,1988 are employees of the housing and <br /> their family members residing in the same unit, and <br /> such employees perform substantial duties directly <br /> related to the management or maintenance of the <br /> housing. <br /> Section VII . Chapter 2, Article 9, Section 2-130 of the <br /> Municipal Code of the City of South Bend, Indiana, is hereby amended <br /> to read as follows: <br /> (a) Six ( 6) members shall be appointed by the Mayor and three <br /> ( 3) members shall be appointed by the President of the <br /> Common Council. Each appointment shall be for a term of <br /> four ( 4) years. In the event of death or resignation of any <br /> member, his successor shall be appointed to serve for the <br /> unexpired period of the term for which such member had been <br /> appointed. Members of the Commission may be removed by the <br /> appointing authority for just cause. All members of the <br /> Commission shall serve without compensation and any five ( 5) <br /> members shall constitute a quorum. <br /> (b) The Commission shall elect from its membership once each <br /> year a chair, vice-chair and secretary <br /> (c) The Commission shall hold one ( 1) regular meeting each month <br /> and such special meetings as the chair may deem necessary. <br /> (d) It shall take the concurrence of a majority of the <br /> Commission membership to take legal or official action..- <br /> except that a determination of probable cause may be based <br /> upon a concurrence of a majority of Commissioners voting <br /> upon the case excluding members abstaining. <br /> Section VIII. Chapter 2, Article 9, Section 2-131, is hereby <br /> amended to read as follows: <br /> The Commission is empowered to and shall do the following: <br /> ( a) Te Establish and maintain a permanent office in the City <br /> of South Bend. <br /> (b) Te Recommend to the Mayor for appointment an executive <br /> director, or such personnel as it may deem necessary, and to <br /> prescribe their duties. <br /> (c) Te Adopt, promulgate, amend and rescind such rules and <br /> regulations, procedural and substantive, as may be <br /> consistent with the provisions of this article and state <br />
