Section VII. Chapter 17, Article 4, Section 17-48 of the South Bend Municipal Code shall read in its entirety as follows: Sec. 17-48 Authorization and Two Year Rate Review. (a) This tariff has been authorized by City of South Bend Common Council Ordinance # and by the Indiana Utility Regulatory Commission pursuant to Cause # approved. (b) The Common Council shall review at least every two (2) years from the effective date of this ordinance, all rates and charges of the Water Works. The Water Utility Director shall file all pertinent data needed by the Common Council, on or before June 1st of the year in which the notes and charges shall be reviewed. Section VIII. All ordinances in conflict with the provision of this Ordinance are repealed upon this Ordinance becoming effective as set forth in Section IX herein. Section IX. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor and legal publication, provided however that this Ordinance shall not become effective unless and until the schedule of rates and charges set forth herein have been approved by the Indiana Utility Regulatory Commission, and all existing rates and charges of Ordinance No. 6829-80 shall continue in effect until such approval. i Membe ' of t -ommon Council
