site, and that moving or demolishing any historic structure that would alter the <br />spatial or the visual relationships in the landscape shall not be allowed. <br />Commissioners Andrews, Deegan, and Gelfman all cite to the Standards and Criteria for Leeper <br />Park in making their decision to deny the COA for the removal of the Navarre Cabin from Leeper <br />Park. These Standards and Guidelines were adopted by HPC as required by Code Section 21- <br />12.04(b)(7). Therefore, the denial of COA#2020-0302 could not be arbitrary and capricious nor <br />contrary to law. <br />A The HPC's decision was supported by substantial evidence and made after thoughtful <br />consideration ofpublic interest <br />The removal of the Navane Cabin from Leeper Park will invalidate its status as a <br />contributing structure to Leeper Park, as listed on the National Register of Historic Places, as well <br />as remove it from the HPC's oversight as a part of the Leeper Park Local Historic Landmark. <br />Commissioner Stalheim, in the June 15, 2020 Minutes of a Meeting of the Historic Preservation <br />Commission, is quoted as clarifying his vote for denial by saying: <br />Commissioner Stalheim (AYE): I voted to deny, as I would like to see more in <br />terms of proposed future funding for maintenance as a way for making up for the <br />loss in historic tax credit resources if they are not able to be attained. <br />The most important aspect of losing its status as a part of Leeper Park is that it will no longer be <br />designated on the National Register of Historic Places, and, therefore, lack access to federal <br />funding. In his letter to the HPC staff, Paul Diebold, the Assistant Director of Preservation Services <br />of the Indiana Department of Natural Resources, states, <br />"Relocation of the cabin will essentially remove it from the National Register of <br />Historic Places, making it ineligible for grants from our office, as well as leaving <br />the cabin potentially unprotected from any review process involving our office." <br />He also notes that, <br />7 <br />
