preservation -commission/) at which one may find an application for a COA, standards and <br />guidelines for specific historical sites, including the Standards and Criteria for Leeper Park, and <br />other useful information. With regard to historic landmarks, Section 21-12.04(b)(6) of the Code <br />requires the HPC to issue a COA before "the construction, reconstruction, alteration, demolition, <br />or moving of any exterior feature of any building, structure, or use. Certificates of appropriateness <br />shall be issued in accordance with the stipulations of this article." <br />If applicants for a COA disagree with the HPC's decision related to their COA application, <br />they may appeal the HPC's decision to the Common Council, pursuant to Code Section 21- <br />12.04(b)(6)(G)(ii).The Appellant is asking the Common Council to review and overturn a decision <br />of the HPC, which was made within the bounds and after due consideration of the Standards and <br />Criteria for Leeper Park, which is attached hereto as Exhibit A. <br />II. Standard of Review <br />In accordance with Section 6 of the "Procedures Governing Appeals of Historic <br />Preservation Commission to the Common Council" issued by the Office of the City Clerk, which <br />is attached hereto as Exhibit B, the Common Council shall determine whether the HPC's action <br />was: <br />a. Arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with <br />applicable law; <br />b. Contrary to constitutional right, power, privilege, or immunity; <br />c. In excess of statutory jurisdiction, authority, limitations, or statutory right; <br />d. Without observance of procedures required by applicable law and ordinance; or <br />e. Unsupported by substantial evidence. <br />3 <br />
