pursuant to the Act and sell such revenue bonds pursuant to the <br /> provisions of the Act, subject to and dependent upon the terms and <br /> conditions hereinafter set forth. The Common Council recognizes <br /> that certain expenditures in connection with the Project and <br /> issuance of the Bonds will be incurred by the City and the Board <br /> prior to the issuance and delivery of Bonds to finance the Project <br /> and the Common Council desires to establish its intention to <br /> reimburse such expenditures as may be incurred prior to the <br /> issuance of such bonds pursuant to IC 5-1-14-6. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF <br /> THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br /> Section 1. Acquisition and Construction of the Project. <br /> The City, being the owner of and engaged in operating the <br /> Waterworks, hereby orders, authorizes, and directs the Board to <br /> acquire any and all necessary property and to proceed with the <br /> construction of the Project, pursuant to the Act and in accordance <br /> with the plans, specifications, descriptions and estimates <br /> heretofore or hereafter prepared at the direction of and filed with <br /> the Board prepared by the Engineers or other consulting engineers <br /> employed by the City for this purpose and filed with the Board, <br /> which are hereby adopted and approved and, by reference, <br /> incorporated fully in this Ordinance, and to finance a portion of <br /> the costs of the Project through the issuance of waterworks revenue <br /> bonds pursuant to and in the manner described by the Act and this <br /> Ordinance, which revenue bonds shall be payable solely out of the <br /> revenues of the Waterworks in accordance with the Act and this <br /> Ordinance. The actions of the Board in connection with the <br /> acquisition of any and all necessary property and the construction <br /> and financing of the Project are hereby authorized, approved, <br /> ratified and confirmed. Where used in this Ordinance, the term <br /> "City" shall be construed also to include any department, board <br /> (including the Board) , commission, officer, or officers of the City <br /> or of any such department, board, or commission. The term <br /> "Waterworks, " "waterworks, " "works, " "water system, " "system, " and <br /> "waterworks system" and similar terms used in this Ordinance shall <br /> be construed to mean and include the existing structures and <br /> property of the Waterworks owned by the City and all extensions, <br /> additions, and improvements thereto and replacements thereof, now <br /> or subsequently constructed or acquired. <br /> Section 2. Description of the Project. The Project <br /> shall be constructed, installed, and equipped in accordance with <br /> the plans provided by the Engineers and the Department of <br /> Waterworks. The Project shall consist of the following: <br /> relocation of the main office of the Waterworks, improvements to <br /> the filtration plant, existing well fields and the distribution <br /> system, renovation and replacement, if necessary, of valves <br /> throughout the City, supervisory control improvements to the <br /> Waterworks system consisting of computerization of system control <br /> mechanisms, additions to and renovations of the Olive Street <br /> 2 <br />
