PERSONNEL AND FINANCE <br />The April 14, 2008 meeting of the Personnel and Finance Committee of the South Bend Common <br />Council was called to order by its Chairperson, Councilmember Tom LaFountain at 3:25 p.m. in <br />the Council's Informal Meeting Room. <br />Persons in attendance included Council Members Derek Dieter, Karen White, Ann Puzzello, <br />Others: Aladean DeRose, Assistant City Attorney; Roger Hamburg, Citizen Member; Kathleen <br />Cekanski-Farrand, Council Attorney; John Voorde, City Clerk <br />Committee Members present, Oliver Davis, David Varner <br />BILL N0.82-07 <br />Aladean DeRose, Assistant City Attorney, spoke to comprehensive changes to the bill from the <br />original proposal, some of which are still under discussion. Inasmuch as what began as an <br />update of the fee schedule now included enforceability issues the administration asked the bill be <br />withdrawn. Council Member Dieter questioned the nature of the appeal process once a ticket has <br />been issued. He differentiated the appropriateness of appeal on a citation written by a sworn <br />officer from one written by a parking employee. He maintained sworn officer cites should not be <br />"negotiated" by the 14th floor. Council Member Varner asked if a record of disposition for cites is <br />kept and if so could be accessible. Council Attorney Kathleen Cekanski-Farrand said the whole <br />appeal process needed transparency bolstered by education and follow-up. Council Member <br />Rouse spoke to a disconnect from a bill's passage to enforcement calling for follow-up and <br />communication. Aladean DeRose promised more of both. Based on a motion by David Varner, <br />seconded by Oliver Davis a motion to strike prevailed. Chuck Clark, licensing director, for the <br />Department of Administration and Finance said all three applicants had complied with all '08 filing <br />protocols, thus recommended the applications be approved. Kathleen Cekanski-Farrand, Council <br />Attorney spoke to the need for a step by step methodical checklist as part of the application <br />process so the Council would know who and why was not in compliance. Chairperson <br />LaFountain on a motion by Council Member Oliver Davis, seconded by Council Member Varner <br />pass the bill to Council favorably. Citizen Member Roger Hamburg expressed views assailing the <br />school board's decision not to allow Hillary Clinton to speak at Washington High School. <br />There being no further business to come before the Committee, Councilmember Tom LaFountain <br />adjourned the meeting at 3:30 p.m. <br />Attachments <br />Tom LaFountain, Chairperson <br />Personnel and Finance Committee <br />
